Terms of use

1. Purpose
These terms of use govern access to and use of the Montia online service, available at montia.ai (the "Service"), published by [company name], a [legal form] with a share capital of €[amount], registered with the [city] Trade and Companies Register under number [SIREN], with its registered office at [address], EU VAT number [number] (the "Publisher"). The Service lets users upload videos (the "Footage") and automatically obtain an edited video and related files (the "Deliverables"). Using the Service means accepting these terms. Purchases are also governed by the terms of sale.
2. Access to the Service
The Service is open to adults, and to minors over 15 with the consent of their legal guardian. Uploading Footage is open to all; starting an edit requires signing in with a Google account, used to identify the user and email them the link to their Deliverables. Each project is reachable through a unique, secret address: the user alone is responsible for keeping it confidential. The Publisher may limit the number of simultaneous projects to keep the Service available to everyone.
3. Content uploaded by the user
- The user warrants that they hold all necessary rights to the Footage (copyright, music, trademarks) and have obtained the consent of the people who appear in it (image rights).
- For the duration of processing only, the user grants the Publisher a non-exclusive, royalty-free licence to store, reproduce and transform the Footage for the sole purpose of producing the Deliverables. The Footage is used for nothing else: neither advertising nor training artificial intelligence models.
- Footage and Deliverables are deleted automatically 72 hours after editing is complete. The user must download their Deliverables before then.
4. Prohibited content
Uploading unlawful content is prohibited, including: child sexual abuse material, glorification of terrorism or crimes, incitement to hatred or violence, harassment, invasion of privacy, counterfeiting, or content intended to deceive the public (fake testimonials, impersonation, undisclosed deepfakes). Unlawful content can be reported to hello@montia.ai; the Publisher removes it promptly and may suspend the author's access, without prejudice to reporting it to the authorities.
5. Artificial intelligence
Deliverables are produced automatically by artificial intelligence systems (speech recognition, language model, render engine). They may contain errors: transcription, spelling, cuts, choice of illustrations. The user checks them before any publication and remains solely responsible for publishing them. Generated texts (titles, descriptions) are suggestions.
6. Intellectual property
- The user keeps all rights to the Footage. The Deliverables belong to the user, who may use them freely, including commercially.
- Music, sound effects, fonts and graphic elements added to the Deliverables by the Service are licensed royalty-free, for use within the Deliverables only (no extraction or separate resale).
- Deliverables produced for free (during the beta or on the Free plan) include an animated "Edited with Montia" banner. In return for the free service, the user agrees not to hide, blur, crop out or remove it, including by re-editing. Paid plans produce Deliverables without the banner.
- The Service, its code, the "Montia" trademark, its logo and its editorial content remain the property of the Publisher.
7. Availability and liability
The Service is provided as is, particularly during the beta. The Publisher uses reasonable means to ensure its availability and security, without guaranteeing uninterrupted service. The Publisher is not liable for indirect damages, nor for the use the user makes of the Deliverables. No clause limits consumers' statutory rights.
8. Personal data
Data processing is described in the privacy policy.
9. Changes and governing law
The Publisher may amend these terms; the applicable version is the one online at the time of use. These terms are governed by French law. In the event of a dispute, an amicable solution is sought first; failing that, the competent courts are those designated by law.
